CONSTRUCTION

Overview

Barakat + Bossa’s Construction Practice Group advises clients on the legal, financial, and operational issues that arise throughout the lifecycle of a construction project. From project planning and contract negotiation through completion and dispute resolution, we help clients allocate risk, protect their investments, and keep projects moving forward.

We represent owners, developers, general contractors, subcontractors, construction managers, design professionals, suppliers, and other project stakeholders in commercial, residential, and mixed-use developments. Our attorneys counsel clients on construction and design agreements, project delays and disruptions, scope changes, payment disputes, lien and bond claims, construction defects, professional liability claims, and other issues arising throughout the project lifecycle.

Construction matters require an understanding of both the underlying project and the business objectives driving it. We work closely with clients to identify potential exposure, structure agreements that clearly allocate responsibility, and develop strategies tailored to their broader commercial objectives. When disputes arise, we represent clients in negotiation, mediation, arbitration, litigation, and trial, focusing on the immediate controversy while protecting their long-term commercial interests.

Areas of Focus

Construction Contracts & Project Counseling

We advise owners, developers, contractors, subcontractors, design professionals, and other project participants on the drafting, negotiation, and administration of construction agreements. Our attorneys help clients address scope, payment procedures, scheduling, change orders, risk allocation, indemnity, insurance requirements, and dispute-resolution mechanisms. By establishing clear expectations at the outset, we help reduce uncertainty and avoid preventable disputes.

Construction Litigation & Dispute Resolution

We prosecute and defend construction disputes involving breach of contract, nonperformance, payment issues, project delays and disruptions, defective work, and related claims. From early negotiation through trial, our attorneys develop strategies that account for the legal claims, the project’s status, and the client’s broader commercial interests.

Construction Defects & Design Claims

We represent owners, developers, contractors, subcontractors, and design professionals in matters involving alleged construction defects, deficient workmanship, design errors and omissions, code-compliance issues, and failures to meet contractual or applicable professional standards. Working with architects, engineers, consultants, and other technical professionals, we evaluate the factual and contractual issues, assess responsibility, and develop strategies addressing both the immediate claims and their broader impact on the project.

Our attorneys also counsel clients through Florida’s construction defect pre-suit process, including claim evaluation, evidence preservation, expert investigation, exposure assessment, and early resolution efforts before litigation becomes necessary.

Delay, Disruption & Scope Change Claims

Project delays, disruptions, and scope changes can create substantial financial exposure and affect the rights and obligations of multiple project participants. We advise clients on claims involving schedule impacts, acceleration, change orders, additional work, and related cost overruns. Through careful analysis of the governing contracts, project records, schedules, and communications, we help clients assess responsibility, preserve claims and defenses, and pursue solutions aligned with their business objectives.

Payment Disputes, Liens & Bond Claims

We represent owners, contractors, subcontractors, and suppliers in payment disputes and in the prosecution and defense of lien and bond claims. Our attorneys advise clients on unpaid contract balances, disputed work, payment applications, retainage, lien and bond rights, and related remedies, helping clients protect their financial interests and comply with applicable contractual and statutory requirements.
