Brian Barakat Presented at the 2024 Annual Florida Bar Convention

Coral Gables, Fla. June 25, 2024 – Barakat + Bossa “B2B” co-founding partner Brian Barakat recently presented at the 2024 Annual Florida Bar Convention held in Orlando, Florida. Brian, Immediate Past Chairman of the Litigation Committee of the Business Law Section of the Florida Bar and Chairman of the Restrictive Covenants Task Force presented on behalf of the  Business Law Section for the 2024 Florida Law Update.

The Business Law Section of the Florida Bar plays a crucial role in shaping legislation that impacts businesses within Florida. This section is comprised of experienced attorneys who collaborate to propose, review, and support legislation aimed at creating a fair and efficient legal environment for businesses. Their advocacy ensures that laws are practical and clear, addressing gaps and inefficiencies to prevent unnecessary litigation and reduce legal costs.

Brian discussed recent legislative efforts in Florida which included various bills such as those on judgment liens, securities and securities transactions:

  • Updates provided during this presentation included key legislative efforts involving HB 175 and SB 984, which aim to clarify Florida’s judgment lien laws. These bills seek to improve creditors’ rights by aligning judgment lien holder rights with Florida UCC Article Nine concerning vehicle titles and allowing the re-filing of ineffective judgment certificates to establish new priority. They address the challenges in judgment collection, particularly regarding general intangibles, and propose solutions to enhance the efficiency and effectiveness of judgment recovery processes.
  • In the area of securities, SB 532 introduces significant amendments to enhance investor protections and access to capital formation. These changes include revising the intrastate crowdfunding exemption, creating the Florida Invest Local Exemption, and modernizing Chapter 517 of the Florida Statutes. Additionally, the bill aims to improve the Securities Guaranty Fund by increasing recovery limits, streamlining the filing process, and eliminating the waiting period for claims, thereby providing more accessible and efficient relief to victims of securities violations in Florida.

Brian is a Florida Bar Board Certified Business Litigator representing clients in breach of contract, lending fraud, unfair competition and breaches of fiduciary duty. A former prosecutor for Miami-Dade County’s Economic Crimes Division within the Special Prosecution Section, Brian’s experience investigating financial fraud and leading hundreds of trials to verdict provides him with a unique perspective on business disputes.
